Terms and Conditions

These terms explain how you may use NODIVEX, who operates it, and what to expect around acceptable use, ownership, availability, and disputes.

Introduction

These Terms and Conditions (“Terms”) govern your access to and use of NODIVEX (the “Service”). The Service is operated by TraitSpan (“TraitSpan”, “we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers to both you and that organisation. NODIVEX is powered by vianodi, a simulation engine and platform also operated by TraitSpan. Your use of vianodi through the Service is covered by these Terms.

Accounts and eligibility

  • • You must provide accurate information when registering and keep it up to date.
  • • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • • You will notify us promptly if you suspect unauthorised access or use of your account.

Acceptable use

  • • Do not misuse the Service, interfere with its operation, or attempt to access it using methods other than the interfaces and instructions we provide.
  • • Do not upload, submit, or share content that is unlawful, infringing, harmful, or malicious (including malware or abusive payloads).
  • • Do not attempt to reverse engineer, circumvent protections, or probe the Service for vulnerabilities except through good-faith security research coordinated with us.
  • • Respect the intellectual property, confidentiality, and privacy rights of others when sharing kata content, diagrams, feedback, or review outputs.

Content and intellectual property

  • • TraitSpan owns the Service, including its software, design, and all original content we provide (such as kata content, documentation, and templates). All rights not expressly granted are reserved.
  • • You retain ownership of the content you create and submit (such as diagrams, notes, and configuration). You grant TraitSpan a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and process that content solely to provide, maintain, and improve the Service.
  • • If you provide feedback or suggestions, you grant TraitSpan the right to use them without restriction or obligation to you.

Beta and evaluation features

Some features may be labelled “beta”, “preview”, or “evaluation”. These features may change, be unstable, or be discontinued at any time. Do not rely on them for critical or production use cases.

Availability and modifications

  • • We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation.
  • • We may update, modify, suspend, or discontinue any part of the Service, and may introduce reasonable limits (for example, to protect stability, prevent abuse, or manage costs).
  • • We may update these Terms from time to time. If changes are material, we will communicate them when reasonably practical. If you do not agree to updated Terms, you must stop using the Service.

Disclaimers and limitations

  • • The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • • To the extent permitted by law, TraitSpan will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
  • • To the extent permitted by law, TraitSpan’s total liability for any claim arising out of or relating to the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim (or £0 if you have not paid for the Service).

Termination

  • • You may stop using the Service at any time.
  • • We may suspend or terminate your access if you breach these Terms, misuse the Service, or if we must do so to comply with law or protect the Service and other users.
  • • On termination, provisions that by their nature should survive will continue to apply, including intellectual property, disclaimers, limitations of liability, and dispute resolution.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which TraitSpan is established, without regard to conflict of laws principles. Courts in that jurisdiction will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, unless applicable law provides otherwise.
